Adjudication

As Chartered Surveyors, Robert Martell & Partners have developed specialist services to assist construction parties in the resolution of their disputes in an accurate, efficient and economic manner. 


Robert Martell and Partners regularly act in the following capacities, either directly for clients or under instruction from their solicitors.


Adjudication 


 Adjudication is an efficient way of settling contractual construction disputes without resorting to lengthy and expensive court proceedings.

The independent adjudicator is agreed by the parties in a dispute or appointed by a nominating body, usually named in the construction contract, and is chosen for their relevant experience and expertise.


The independent adjudicator considers the evidence presented by each of the parties to an adjudication and delivers a decision.


Adjudication Advantages


  • A confidential decision must usually be reached in 28 days
  • An adjudication can be started during a construction project to resolve interim disputes quickly – assisting cash flow and allowing works to progress.
  • An adjudicator’s decision is binding (unless set aside by arbitration or the courts)


Our Adjudication Services


  • Expert advice on the adjudication process, under either contractual or statutory provisions
  • Expert advice on whether or not adjudication is an option available or whether it is the most effective option - there are  occasions where adjudication is not available
  • Advice on the merits of your case, the likelihood of success and what you are likely to recover
  • Formulation of the adjudication documents including the Notice of Adjudication, Referral, Response and all other documents
  • Management of the adjudication process from end to end, including enforcement of the decision if necessary
  • Service of documents including the use of specialist “Process Servers” for more complex cases
  • Managing jurisdictional challenges
  • Liaison with legal representatives or counsel.
  • Advising or presenting the merits of your adjudication to your board or management team.
