Adjudication
Adjudication is an efficient way of settling contractual construction disputes without resorting to lengthy and expensive court proceedings.
The independent adjudicator is agreed by the parties in a dispute or appointed by a nominating body, usually named in the construction contract, and is chosen for their relevant experience and expertise.
The independent adjudicator considers the evidence presented by each of the parties to an adjudication and delivers a decision.
Adjudication Advantages
- A confidential decision must usually be reached in 28 days
- An adjudication can be started during a construction project to resolve interim disputes quickly – assisting cash flow and allowing works to progress.
- An adjudicator’s decision is binding (unless set aside by arbitration or the courts)
